Skopje, 02.15.2017 – Organization of Employers of Macedonia (ORM) has established a working group whose task will be to prepare a draft amendment to the Law on Notary and law for enforcement. The working group is composed of experienced professionals from the business sector, summarizing the experiences and consequences of the application of the contentious provisions of these laws will put together a concrete proposal, in consultation with the chambers of commerce and other social paratners the Economic and Social Council, will be the top proposals will be submitted to the new Government and Parliament for consideration and adoption.
“With several offerings contentious provisions in the laws governing the notary and the enforcement activity, which came into force earlier this year, badly is disabled on human rights in companies representing the interests of their companies, because these laws it right they were exclusively granted only to lawyers. In this way, not only unduly favoring lawyers on behalf of lawyers in the companies, but also directly increase the cost of companies that affect the reduction of their market competitiveness, “said the president of OEM, Angel Dimitrov, noting that the organization already arriving information from Goverment which are faced with increasing costs due to hiring lawyers are forced to think and redundancy of their legal services solely because it deals with highly educated people passed the bar exam and extensive practical experience.
In ORM say that unequal treatment of lawyers against lawyers in companies constitutes direct discrimination imposed by the aforementioned laws, which in itself raises the question of constitutionality.
Experts also point the lawyers under the Civil Procedure but also by European legislation are not and can not be solely responsible for providing legal aid. They are some of the only legal profession and have the same knowledge and skills as well as other persons with completed law school and passed the bar exam. Because lawyers can not be favored compared with lawyers, that just because they have chosen to work professionally in companies does not make them less qualified lawyer and they provide appropriate legal assistance.
In addition, the disputed provisions of laws enforcement and Notary abolishes the right of companies directly and independently to choose the simplest and most effective means of legal protection and representation in proceedings before a notary or enforcement procedure.
